What should J do?

So .. someone I know, I'll refer to them as J, was driving the other day, and they went to switch lanes but didn't realize there was someone next to them. The girl next to J swerved, and hit the curb, popping a tire and denting their rim. That was the only damage, as J didn't actually hit the girl next to them. The guy that was with the driver of the other car did not want the cops involved, and actually seemed to be worried when they were mentioned or seen. As J went to try and find a tire and rim that would fit, the girl in the car told J's g/f that she really didn't even have a license. Anyway, she got the car towed, and J gave the guy $80 as she said to do, and that was all he had, but said he may be able to get her a rim and tire, and she said that was fine, and that she would give J's $80 back if that was the case. Now the girl is saying she talked to her dad, lied to him and said noone else was involved and said he wanted it fixed at Century Tire. So she told J that she would just take another $40 and take the loss on the difference. J told her that, that wasn't the deal and that he wasn't giving her any more money, but that he could probably still get her the rim, and because her dad wanted it done at Century Tire, she could keep the $80 for a new tire, and put it on the rim that J was getting for her. She said that she would talk to her dad but that she was probably going to take it to Century anyway, and just file a claim for insurance. She says she has 72 hours to do so, but she doesn't have any of that info, all she has is J's name and cell #. J is going to call her tomorrow morning to let her know about the rim, but if she's going to be a grandma and just take it anyway, what do you think J should do?

Pay up?

Give her insurance info?

Tell her to fudge herself?

I'm partial to choice 3, be he wanted more than my opinion, so I figured I'd ask ...

 
Most of the fault for the incident falls on J in this case. The fact that he failed to make sure the merge was safe to perform. The good thing is that it did not end up as an accident with car body damage/injuries, and the driver of the other car takes credit for that, for reacting to the situation to avoid the accident. The curb is to balme, it was there at the wrong time.

(J/K) There's mixed thoughts on this issue. First, if the cops were involved, the driver (and passenger?) of the other car would've been in more trouble, so J did them a favor by not contacting the cops. If he would've done so, J's insurance would've been affected, but he would've saved himself from PITA of dealing with the person.

At this point I would not give them any ins info, since i think it's pointless without having proper police report, etc. Alll it will do is hurt J's ins and leave him $80 short.

$120 is not such a big price to pay to get them off his tail, might talk them down to 100, if he can.

The cops weren't involved? Tell her to takea leap! She swearved and hit the curb. She is a moron. No contact by you? She's on her own. No proof at all. They ain't gonna call insureance, she s got no licence!

Forget her name man, she'll lose your # before long.

 
Reportable accident is a total of $1000 meaning this is not a reportable 10-55. The parties talked so she can't say that he left the scene. She could go through a civil suit but it would hardly be worth it. I would talk to her and try to work it out and save some head aches. As far as insurance goes I would think that the deductible would be $50-$100 again not worth it.

 
She said she would take $40 more and take the losses ... should J even give her that seeing as how she changed the deal because she lied to her dad? J really doesn't want enemies down here in Portland ... he's already had raisin stolen from his car :

I was on the receiving end of an incident like this. A Jag cut off a Ford Explorer in front of me, which caused the Explorer to slam on his brakes (wet pavement) and me to rear-end him. While it was "The Jag's Fault" it was circumstantial and became irrelevent with the Insurance company.

This chick has no way of proving J's involvement. As Shorty noted, there was no bodily contact. Furthermore, driving with a suspended (or lack of) license is against the law. By not calling the cops, you did your part in saving her a$$. Little-miss-curb-hitter needs to anti-up and pay the rest of the damages herself since she wasn't supposed to be on the road to begin with.

 
Little Ms Lying Cheating Chiseling Double-Dealing Curb Hopper sounds like she is long overdue for a reality sandwich.

J should contact her dad and update him as to the actual facts involved.

Otherwise she will just continue to escalate her unrealistic demands, in which case J should simply shun her. If in fact she doesn't have a license, her demands are going nowhere anyway.

 
At the scene, she told multiple people that she did not have a spare, yet J was told on the phone yesterday that she "can't drive around on this donut for much longer"

 
Tell her to keep the $80 cash and to go screw. Not worth the time or aggravation, IMO. She's a liar, who will most likely try to milk this for all it's worth. I'd get in touch with her father and be up front and honest about what happened if this starts getting out of hand (and it most likely will).

At this point, it's a private matter. No need to involve the Ins co. The time has passed on that. I'd either tell her to screw or talk to her dad.

it already IS out of hand. she's proven to be a serial liar and has escalated the stakes at every step.

The whole matter is complete bull in the first place, J's girlfriend keeps telling him to not worry about it. He most likely wont get back the money he gave to the drivers boyfriend. The driver of the vehicle informed J and his GF that if they got her a tire and a rim that there would be no issues. This situation has gotten so out of control. J still has hope that maybe the other driver will give back his money and get screwed but the only people I see getting screwed is J and his Gf! >

I would've called teh cops and had her ass hauled away for driving w/o a license. Enjoy your time in the pokey!!!! J may have done her a favor by not calling the cops, but J has done a dis-service to society. Maybe if she had a license she would've known proper accident avoidance other than plowing into a curb.

Just an opposing argument...

 
I think we are all in agreement that the no license, liar, girl can go get bent!

With no license that car should not have even been there in the first place. J has already done more then they have to. Not calling the cops, offering to get a rim and tire, giving her $80. The girl should be grateful.

I agree with mikebike, they should have called the cops in the first place and saved all this headache.

But, at this point J needs to count their loses and forget the whole situation. If the girl makes an even bigger deal about she's just asking for more trouble and will eventually find it.

Well, J told them that they could have the insurance information they wanted after he recieved the $80 back, and was able to see license, registration, insurance, and the receipt for getting the tire fixed. She told J that was fine, and her dad wanted the insurance info. She told J she would call if he changed his mind .. and J let her know (which he now regrets) that the insurance deductable was at least $200, and where she only paid $160, she wasn't going to see money from the insurance comp. regardless ...

Surprise, surprise ... guess who didn't get a call back for the ins. information?
