im not exactly 'emotionally stable' right now

so heres the condensed version.

got pulled over, NO REASON. cop starts GRILLING me about being in a hit and run. he was posted in the area the accident happened and i drove by. slight damage left over from that deer.

they called the asshole over. he stands with the cop twenty feet from my car IN THE DARK. they talk for 5 minutes

he says its me. and then drives off. i have to go to court over it.

i had absolutely no chance to defend myself. didnt get to talk to him or see his car.

he said my SUBARU. T-boned his EXTERA. and scratched his rocker pannel. because i have STRESS FRACTURES IN THE PAINT OF MY 8 YEAR OLD BUMPER?!?!

can this horse POOP actually stick?

i just cant do it. i work 30 hours a week, i go to school 30 hours a week.

If you have pictures from the accident with the deer I would bring them for proof. That's a bunch of bs!

 
Remember, its innocent until proven guilty.. if the PD did not get forensics from the other car (meaning matching paint) i don't think it would stick.. plus yeah, you had pictures of the Car vs Deer...

sounds like a job for f. lee bailey. I learned he is a maine resident.

on the other hand, in contrast to your case.. I got hit in broad daylight, in front of the bangor post office, halfway up a hill, in the sunshine at rush hour... and not a f***** clue was left to catch the fat sow I got a perfect ID on...nor her vehicle?!

decipher that one. I even assumed cameras at the post office.. but no. they did not want to see what mcVeigh type character was crashing towrads them apparently, and there is no cameras...

it gets stranger as you go north.. I am confident your case gets resolved. I am still unresolved in this location...and am going to leave that way.. a lot of unresolves.

 
i am paying 30,000 dollars to go to school to be a mechanic. i work my DONKEY off. i have a completely clean record. if this messes that up im going to loose my mind.

 
You also have the posts on here about the hitting the deer. You can use that to show the dates, and what happened. That is BS. Sounds like the cop didn't even really do his job

 
Yeah, that sucks. But remember the cop can only go by what he has for information, but it doesn't sound like he did much investigating. I'd call the DA's office when you get info from them, and tell them your story and try and get them to drop the charges before you even go to court. It could really save you a lot of headaches.

^this. DA's job is to prosecute the strong cases and dump the weak ones to minimize wasted time and expense for the court.

id like to make a case against the cop and the guy whos accusing me. i feel my rights were violated. he treated me like i was a criminal from the moment he saw me, gave me no chance to defend myself. wouldnt even let me talk to his guy or see his car. and the damage i supposedly did

AT LEAST file a formal complaint against the officer

*remember this is all in mass.

in all honesty, it sounds like you have a solid case- you could hire a lawyer and sue for legal fees. i bet a lawyer would be glad to take on your case.

if you want to grandstand and make a point against the system in court....well good luck with that. so the police were brusque with you, get over it, talk to DA first ad foremost. he will suss out the case. realize that you white subaru criminals all look alike!

if you do decide to press the issue, be prepared to spend serious $$$ on legal counsel and be equally prepared to lose, you have basically a 50-50 chance once your court appearance actually takes place.

 
i have no idea how any of this works. if it goes to court id like to counter sue for legal fees, as well as maybe some type of emotional distress or harassment or some crap

but if the DA throws it out i wont go looking for any retribution.

theres no way this guy can actually prove i hit his car...

 
good luck suing the police.

your chances of coming out on top of that are somewhere between slim and none.

Just call the DA, present your evidence of the deer hit and they will most likely drop it.

this is why you should just start with DA, tell them the facts, present evidence and pics and web posts about deer hit....there's a probly 95% chance DA will toss the whole thing

if the case is not tossed then, and only then, do you kick it up a notch. like I said just be prepared to spend $$. you cannot do this on your own, lawyers are expensive. they are unlikely to work this case for contingency (they get $ if u win, nothing if u dont). on initial consultation, the lawyer is likely to tell you your chances are either 1) fair (best you can expect) or 2) slim to none based on what you can provide for evidence.

and like Pedro said, good luck suing police for emotional distress. In the violent world we live in today, police simply can't afford to be all that nice in doing their job. they have to establaish control of every situation and that's guaranteed to inflict stress on the ppl involved. you think you have stress from a traffic stop? just imagine the job stress of having to stop unknown wierd drunk armed pissed-off people every day you work! You don't have to wear a pistol and body armor in your job do ya?!

so calm down, get your evidence together and contact the DA. remain calm, don't start in on him about pain and suffering....just stick to the facts that you car was damaged weeks ago and how you can prove that. it'll be OK!

PS--am not a lawyer but I play one on MS!

thanks a lot guys! Once again i get great advice and support from my friends on mainely subaru's. ill contact the DA and just try to get it thrown away

might have evidence from school that shows me leaving at that time

ill keep you guys posted. im not worried abut losing in court, it just sucks i have to deal with this. due to this storm i have my first real day off here since august and i cant even enjoy it! never mind go drifting in the subaru for fear or damaging it...
