Transmission problems

Moral dillemna...

Insurance company says they will cover the damages done to the transmission if I give them the receipt for the work done by the guys in their garage. I firmly believe they are not at fault for what happened. I have no doubt in my mind that AAA is responsible.

Do I:

1.) Deny the agreement and continue to push toward AAA being accountable and risk not obtaining a settlement.

2.) Give the receipt, get the money and let the Insurance Company and the two dudes duke it out, believing they are not to blame.

 
No, they do not - but they know I live in Haverhill (as do they) so it wouldn't really be difficult to track me down I don't think. One of them is now un-employed because of Union layoffs and the other owns a house.

 
Eek - well, here's how it would go - you give your insurance the receipt, they go knocking on the door of shadetree mechanics. They say "it wasn't our fault." Insurance company then would have to prove that it WAS their fault before they can extract dollar 1 from shadetree mechanics. I'm assuming that shadetree mechanics don't have a corporation set up, meaning that the insurance company could go after their personal posessions to make up for it.

I'd email the guys and tell them that the Subaru place and your insurance company think it's their fault, and offer one last time for them to make it right. It sounds like you don't think it's their fault, but you gotta go with the experts' opinion at this point.

If they don't fix what they broke at that point, it's time to take it to the next level. If, after your insurance company investigates, it's decided that it was indeed AAA's tow that broke it, then your guys are off the hook.

 
If you truly do not think it was the "mechanics" fault then leave them alone. IMO there is way too much "I don't want to lose something, but it's OK if someone else does" in the world. Do the right thing!

 
^ I agree - if it's not the mechanics' fault, then they shouldn't be on the hook. Right now, however, what Redline "thinks" is the truth may not "be" the truth. Who knows? Maybe the mechanics didn't do anything wrong? It's up to the insurance investigator to find that out.

All I know is, based on what Red has told us so far, it's not HIS fault. How fair is it if he has to pay for something that isn't his fault?

 
And that sums up what I feel. However, being a small business owner myself... yeah.

Honestly, I'd rather get the shaft than see someone who doesn't deserve it get the shaft. I'm a softy like that...

 
Funny you should say that - when it's a problem involving ME, then I'm exactly the same way. If it's involving one of my friends, however, I'm a no-feeling, heartless bulldog on their behalf.

Strange.
