Ryan--so if the other guy's ins is kicking in to cover your loss, make sure to have your ins agent advise you how to make sure you get max coverage and how not to get nickeled and dimed (and hundreds thousands of $$$) to pieces on this.

typically the ins co will tend to declare th car totaled if repair est exceeds 40% of car's cash value -- cash value in their eyes not yours which sux but that's how it is. so make sure you can deliver the receipts for upgrades you've done. stixx is right, they will fight to minimize their payout and they have lots of practice at that slimey game

 
If its totalled tell them if they total it you want to keep the car, that way you get the value of the car minus what they charge you to buy back the wreck, nothing says you can't fix a total car. My parents did this with thier subaru 5 or 6 years ago, they still drive it.

Also, be aware that I have State Farm so claims are easy for me. I have never had a problem with a claim on anything and I have always been satisfied. I probably pay a little more for my insurance, but the peace of mind having State Farm gives me is worth it. Even on this new car, I just drop it off at the shop, then come back when its ready and pay the shop the deductable. Simple and easy, the way it should be. They have also been easy to deal with when we don't want such a straight foward repair (aftermarket stuff) and if we don't want a repair, they don't have a problem with that, they just take photos for record and cut you a check. When they send an adjuster to assess the damage they have always estimated a like new repair with OEM parts, then you can dispute that if you lost aftermarket parts and have proof, they try to be fair and negotiate compensation. I would highly recommend them, I have always been happy with them. They almost seem too easy to deal with.

Just get ready to fight, but fight clean. Be respectful with the ins rep, but firm.

The noob that just got transferred onto my claim to close just offered me $4000 to cover ~$8000 in medical, $3000 in time out of work, ~800 miles of transit to appointments, and $40 in tolls. Not to mention scars to my beautiful face, back probs, and constant headaches.

 
If you end up needing or wanting to source parts let me know... I have control arms and strut assemblies just laying around... wagon struts too so you'd get some free camber.

Another phucking to avoid:

The bastids also will devalue your USED (and not-so much so) parts.

I have +20K in rcpts, I'd be lucky to get my "insured for" $12K after they depreciate the parts.

"Replacement value" for "used" (because you use them!) JDM parts doesn't compute with insurance companies, much.

What DOES compute is,

"I'll represent myself in court, sue you, and waste a team of your lawyers time, costing you more than it would to (fairly) pay me what I'm due."

I've stated the above, to Progressive, & got what I wanted-those asshats.

 
if the car is repaired, ask your insurance company if you can negotiate with the other company for money towards the depreciation value of your car. i wish i had done that with mine. they'll tell you they'll repair it to "pre-loss condition" but not "pre-loss value".

 
that sucks to hear and see man. hopefully the car is back the way it should be after the repairs. look into any mods you might want while its apart and before the new parts are purchased too, like carbon hood vs. stock or whatever.

Still no estimates yet. My insurance company should be going tomorrow to make one. The body shop says there is a possibility it could be totaled, but was pretty confident that the value and condition of the car would not result in that. Plus, with the accident being 100% NOT my fault, it gives me a bit of an upper hand.

Reciepts will get you paid, ghat, and don't settle TOO quick, even if it sounds good.

I got a rental from Enterprise for $26.99 a day. Their insurance is paying $24.99 a day, and will pick up the difference.

 
Oh, nice ... I thought larger companies like that require you to be 25 in order to drive their vehicles. What did ya get?

 
It sounds like it wont be totaled, which is good in your case, i guess i was just in a different place when my 240 was t-boned but my scenario was

Payout for car 5,600 owed 0

bought car back for 600

Proceeded to sell everything on the car (turbo kit, diff, suspension, trans, motor, doors, dash, rims, brakes, seats etc etc)

for about another 5-7k total.

While is didn't recoup all of my initial money it wasn't as bad as it could have been.

Now it just looks like you need to have a friend who is a shop owner to help you reproduce a receipt (for any you might have lost) for those products you bought from him.

 
So an inspector came out today and looked at the car. The body shop came up with a $6200 bill from a visual inspection. I will know what the inspector comes up with on Monday. As far as it being totaled or not, the body shop and the inspector both agree that its going to be a very close call being considered totaled or repairable. It's eating away at me big time... if they claim it totaled, I'm not standing down to this and it won't be the end of this battle.

Now, I also have another battle to fight. The dumbasses that towed my car to the body shop decided it was a good idea to take the bumper and the bits and pieces off the OTHER GUYS car and put them INSIDE my near perfect interior

WTF? The body shop couldn't believe it either. Now I'm gonna have to file a complaint with AAA.

 
R, it's clear this is an emotional issue for you. but if they DO total the car it's not end of the world. Just buy the wreck back from ins co and part it out, you'll come out better financially than if they just repair it. Take a step back, a couple of deep breaths and just cruise thru this...not every step demands a fight ya know!

As for the nummahs in the wrecker filling your backseat with the other guy's busted bits, they probly looked at your car and figured it was totaled so they were like Farkit, that thing is toast anyway. Wrecker crews can spot totals pretty much as good as any adjuster.

Just let the car go if they do total it. In fact, this may be the best things that could happen from this sad situation. I had a 5200-mile Tacoma TRD V6 that got heavily sideswiped and was a near total. I fought to keep that particular truck (first brand-new new vehicle I'd ever bought) and eventually regretted the decision. Even after it was repaired and looked pretty darn good on the outside, that thing had more squeaks and rattles than any Toyota you ever heard. You may well be much better off in the long run starting over with another (straighter and non-crashed) WRX.

The most important thing is what works for you long term, as opposed to the inconveneince of not having your bugeye for a few weeks. Driving a rental won;'t harm you, and think how much fun you'll have building another nice Rex that really IS straight and tight like it's spozed to be.

Yeah I'v talked to him some seems a little stressed out about it..which i don't blame him for being.. But I believe hes going to still ride up with me and make the meet Wednesday
